Extended Jamie Spears as conservator

PDF
brit.jpgThe hearing is over and the Commissioner in Brit's conservatorship has extended Jamie Spears turn as conservator until the next hearing on March 10. Commissioner Reva Goetz's current orders are still in effect-- Brit's conservators still have the power to deal her financial issues.
The Commissioner has also ordered that Britney undergo what's called a 730 evaluation-- the results of which need to be turned in to her by the next hearing.

As for Sam Lutfi, we're told he's hiding out and still hasn't been served with the restraining order. One lawyer even said "I believe he is intentionally avoiding service." The next hearing on the restraining order was previously set for Feb. 22 -- and he must be served at least 48 hours before then.

A commissioner will consider extending Jamie Spears's temporary control over his daughter's estate in a hearing Thursday afternoon, amid signs that his approach is keeping Britney Spears safe and out of trouble.

The singer's father has been overseeing her well-being and her $40-million fortune since Feb. 1, when Los Angeles Superior Court Commissioner Reva Goetz named him and Andrew Wallet temporary co-conservators – giving them the right to employ bodyguards who control her actions and restrict her visitors.

Since then, they seem to have kept the pop princess on a tight leash, forcing Britney to keep an uncharacteristically low profile (no appearance of her pink wig, no overnight stays at the Four Seasons). Although she has been spending much time holed up at her Summit house, she was recently spotted shopping with her mom, Lynne, and has been making regular trips to the Millennium Dance Complex.

Text-Messaging Friends
While Spears has been on her best behavior, sources say she's been text-messaging friends from inside the house, complaining that she's bored.

"She's getting proper medical care and has professional security. The chaos has been removed from the situation," says one legal insider, who anticipates that Goetz will prolong the temporary conservatorship at the hearing. (Proceedings are scheduled to begin at 1:30 p.m., Pacific time.)

It is possible Spears could appear, although she has consistently avoided the courtroom in the past. The 26-year-old will be represented by her court-appointed attorney, Samuel Ingham.

, asking that Britney's conservatorship case be taken away from L.A. County Superior Court.

In the documents obtained by TMZ, attorney Jon Eardley claims Britney's rights have been snatched away from her and she has been cut off from life as she knows it.

Eardley claims, "It is doubtful that Ms. Spears can receive equal protection and a fair trial or hearing in the custody proceedings because of the intense media scrutiny of what would normally be private aspects of a person's life." It appears Eardley wants an injunction issued in federal court, asking the judge for the power to protect Brit in the custody case as well.

The documents allege "the deprivation of her civil liberties by the conservator is so severe as to interfere with the effectiveness of the scheduled medications that are covered by the Food, Drug, and Cosmetics Act." This appears to be an attempt to get the Federal court to accept jurisdiction.

It is unclear on whose behalf Eardley is acting. We're told Sam Lutfi and his publicist, Michael Sands, have something to do with the filing, though the exact nature of their involvement is unclear.

TMZ.com is also reporting that Britney's 30-year-old brother Bryan and attorney Ivan Taback have been granted the authority to serve as co-trustees.

According to documents filed today, Britney is the sole trustee of the trust. But, according to the trust, "an individual Trustee shall cease to act as Trustee hereunder if he or she is under a legal disability or if by reason of illness or mental or physical disability, in the written opinion of two doctors then practicing medicine, he or she is unable to manage his or her affairs."

Since Bryan and Ivan Taback were named successor co-trustees, they assume control. Stacy Smith is also named a successor co-trustee, but had previously declined her appointment.

Stay tuned.
